GENERAL REMARKS

Uzbekistan used to be part of the former Soviet Union. The republic declared its independence on September 1, 1991. The State Patent Office of Uzbekistan was established on October 1, 1992. The term for re-registration of former Soviet Union Industrial property rights in Uzbekistan expired on October 1, 1994.

  • Power of Attorney (no legalization);
  • Specification, claims and abstract (may be filed in Uzbek or Russian language);
  • Drawings, 3 sets (A4);
  • Priority document, if claimed, to be filed within three months from the filing date;
  • Payment of the official filing fee (must be paid within three months before filing, and receipt submitted).

REMARKS

National Phase of PCT: under Chapter I: 30 months; under Chapter II: 31 months.
Validity: issued after formal and full examination - valid for 20 years.
Annuities: are to be paid after the publication of the granted patent; subsequent annuities are payable after the anniversary of the filing date.
Opposition: may be presented by any physical or legal person within three months of publication in the Patent Office Gazette.

FILING REQUIREMENTS

  • Power of Attorney (no legalization);
  • 10 prints of the sign to be protected (8 x 8 or 8 x 16 cm);
  • List of goods and services, according to the International Classification (to be translated into Uzbek or Russian); one application may include goods belonging to several classes;
  • Priority documents, if any.

REMARKS

Kinds of protection: trademarks and service marks (wordmarks, device marks and combinations thereof; three-dimensional marks, sound marks, marks perceived by smell, holographic marks, luminous marks). Besides the original version, filing of wordmark applications in the Cyrillic alphabet is highly recommended, as the Uzbek language uses the Cyrillic alphabet, and the Russian still being a parallel language in the country.
Classification: International.
Obligation to use the registered mark: compulsory. A trademark, which is not used during any five-year period after the registration date (or the last date of use), may be cancelled upon request filed by an interested party; nominal use (advertising, publications) is accepted in absence of actual use.
Duration - renewals: 10-year period after the filing date or last renewal date (note: marks re-registered on the basis of the former Soviet Union registrations are due for renewal 10 years after the Uzbek filing date, or the last renewal date in the former Soviet Union).
Opposition: not provided for.
