GENERAL REMARKS

Azerbaijan used to be part of the former Soviet Union. The republic declared its independence on August 30, 1991. The Patent and License Department of the State Committee of Science and Technology was established in June 1993. The Office was re-organized, and the Patent Department of the State Agency for Standardization, Metrology and Patents established in August 2002.

Former USSR industrial property rights filed prior to December 25, 1991, could be re-registered in Azerbaijan until December 31, 1995, and the corresponding Azeri Certificates of Registration have already been issued for all cases registered on the basis of the former Soviet Union rights.

Besides the original version, filing of wordmark applications in the Azeri language, as well as in the Cyrillic alphabet is highly recommended, as the Russian language is still being a parallel language in the country.

Obligation to use the registered mark: must be used; if not used within any five-year period after the registration (or last use) date, the mark can be cancelled upon request of an interested party; nominal use (advertising, publications) is accepted in absence of actual use.
